$10,000,000 Auto Versus Motorcycle | Wrongful Death

This tragic case involved a fatal vehicle vs. motorcycle left turn accident at the intersection of Exposition Blvd. and Bundy Dr. in West Los Angeles.

Investigating officers assigned fault with the 16 year old left turning driver. Our amazing co-counsel Karen Gajewski and Ed Baughan determined that left turns were to be prohibited at this intersection as a result of Metro Line construction. Even the officers missed that there were supposed to be 3 no left turn/u-turn signs with 2 elevated on the N/W and N/E light poles and 1 in the median. The sign in the median was missing.

We were brought in to bring a claim against the Construction Co and other entities responsible to make sure that median sign was present. These defendants contended that they did nothing wrong and that the accident was the exclusive fault of either the inexperienced 16-year-old driver who had been driving for 6 months (he admitted he knew it was a no left turn intersection, but turned anyway claiming the path was clear) and/or the decedent on the motorcycle (who defendants claimed was heavily impaired from marijuana use.)

The Homampour Law Firm handled this case through trial and convinced a jury that the construction company, Skanska-Rados Expo 2 Joint Venture, was responsible and that decedent did nothing wrong. The jury awarded $10 million in wrongful death general damages to Plaintiffs (the wife and mother of decedent) and apportioned 55% against the construction company.

In April 2017 Attorneys Arash Homampour and Scott Boyer successfully obtained a $14.25 million dollar pre-lawsuit settlement for the wrongful death of a 53 year old motorcyclist who left behind a loving wife and three children.

An experienced rider, the decedent was navigating the carpool lane on CA I-105 when he was hit by the defendant driving a rental van.  The defense contended that decedent travelled through the double yellow lines without showing due care and was therefore liable for the accident.  Not only that, the defense disputed the nature and extent of the damages claimed.

Through impeccable efforts, gathering of eye-witnesses statements and utilizing the latest accident reconstruction techniques, the Homampour team was able to demonstrate that it was in fact the defendant who made the unsafe and illegal move across the double yellow lines, thus colliding with decedent and causing his fatal injuries.

The Homampour team was also able to ascertain that the defendant was working for her employer at the time, making them vicariously liable for the incident.  While this enabled the Homampour team to secure a sizeable award for the family, it can never replace their loving husband and father.

One Simi Valley motorcycle patrolman is lucky to be alive after his motorcycle was involved in an accident with a truck on Wednesday, June 15.

The accident happened shortly before 5 p.m. as the officer was headed south near Los Angeles Avenue on Tapo Canyon Road. As he entered the intersection, a pickup truck going in the opposite direction made a U-turn directly into his motorcycle's path.

There will be no holiday celebrations this year for one motorcyclist killed in a wreck in Gardena on Dec. 17.

Officials report that the fatal accident involved a minivan and occurred shortly before 5:20 p.m., at the intersection of Purche Avenue and Rosecrans Boulevard. First responders included both Los Angeles County firefighters and police.

The initial investigation indicates that a Honda minivan was eastbound on Rosecrans carrying three occupants. The minivan attempted a turn north onto Purche, but collided with a westbound Triumph motorcycle, according to police.

There is no question that motorcyclists are at greater danger of suffering fatal injuries than those who ride in passenger vehicles. Yet statistics from 2013 indicate that motorcycle deaths dropped 6.4 percent from 4,986 the year before to 4,668.

Statistics from the National Highway Traffic Safety Administration during the same year showed that out of each 100,000 registered motorcycles, 56 had involvement in a fatal accident. This compares with the nine out of each 100,000 cars involved in fatal wrecks, meaning that in 2013 alone, motorcycle riders were nearly 26 times likelier to be killed in a wreck for each mile driven than their counterparts in four-wheeled vehicles.
