Employers should be proactive in preventing harassment and discrimination before a victim comes forward. Whether they suspect bad activity or not, all employers should adopt and publish policies stating that employee emails and internet usage may be monitored, and give themselves the tools to police their email and other shared systems to uncover harassment. ESPN, the NFL and its teams could have prevented a culture that promotes harassment if they followed these simple processes, and while nobody is irreplaceable, the damage done to players, fans and the league’s reputation could take years to repair.
